Elections in Kenya are won at the ballot, but they are often settled in court. Election disputes run on some of the shortest and strictest timelines in Kenyan law, and a single missed step — a late filing, an unpaid deposit, a defective service — can end a strong case before it is heard.

Bonuke & Co. Advocates acts for petitioners, elected officials and political parties at every stage: from party nominations, to petitions after the results are declared, to appeals. With the next general election set for August 2027, we also help aspirants put the right paperwork and evidence in place well before polling day.

How we approach an election dispute

We start by testing the evidence quickly. Within days of the declaration we gather Forms 34 and 35, agents' statements and polling-station records, and we tell you honestly whether the irregularities are serious enough to affect the result — the standard the court will apply. If the case is strong, we file on time, pay security for costs, serve correctly and push for scrutiny or recount where the evidence supports it.

If you have been declared the winner, we defend the result with the same urgency, raising procedural objections early and answering every allegation with evidence.

Who we act for

  • Elected leaders whose victory is challenged
